Deputy Majority Leader Joseph Victor "JV" Ejercito pressed for a reconsideration of the "unfair" practice of "automatic[ally]" detaining hapless drivers entangled in vehicular accidents resulting in death.

"Halimbawa, sumalpok sa truck, lasing 'yung rider. Kasi nangyari sa'min to, 'yung delivery truck namin ng yelo, nakaparada lang, nagbababa ng delivery, binangga nung nakainom na naka-motor, namatay yung naka-motor. Agad-agad kinulong 'yung driver ng truck," Ejercito said as an example during the latest Committee on Public Services hearing.

(For example, a vehicle crashed into a truck, the rider was drunk. Because this has happened to us: our ice delivery truck was just parked, bringing down deliveries, when a motorcycle rider who was drunk hit the truck and died. The truck driver was immediately incarcerated.)

The senator said it would be good to prioritize the Fair Apprehension Act, as it is "unfair" to imprison motorists not responsible for fatal mishaps.

"Magandang ma-discuss natin 'to, because it's also unfair for drivers who get involved in a mishap na kahit hindi kasalanan, automatic kinukulong kasi may namatay. Tulad noong sa--alam ko may sumalubong sa Skyway ba 'yun? Sumalubong na nga po 'yung pumasok na motor, pero kinulong pa rin 'yung nasa tamang daan," he cited another unfortunate incident.

(It would be good to discuss this, because it is unfair for drivers who get involved in a mishap not of their doing to be apprehended automatically because somebody has died. Like in the incident where, to my knowledge, a motorist came from the wrong direction at Skyway? The motorcycle rider had already come from the wrong way, but it was the one on the right lane who was locked up.)

Ejercito stressed that fair apprehension should be enforced as there are now CCTVs to determine which party is at fault, and that motorists who have proof of their innocence but are put behind bars anyway are "pitiful."

He is working alongside Senator Rafael "Raffy" Tulfo, who is Chair of the Committee on Public Services, in drawing up a solution.
