The Commission on Elections (COMELEC) En Banc on Thursday junked the Motion for Reconsideration that seeks to declare presumptive president Ferdinand Marcos, Jr. as a nuisance candidate in the 2022 elections.
In its resolution, the COMELEC En Banc resolved to deny the motion filed by Danilo Lihayhay for not making new assertions in the case.
"A careful review of the Motion for Reconsideration reveals that it contains merely a rehash of Petitioner's averments and arguments," said the decision.
"The motion failed to raise new matters or issues, and the grounds that would warrant the reversal of the Assailed Resolution," it added.
The decision was released three days after election day, and two days after the COMELEC also junked the petitions seeking to disqualify Marcos Jr. for his failure to file income tax returns when he was a local official in Ilocos Norte.
Marcos Jr. is the leading candidate in the partial and unofficial tally for presidency as of Wednesday evening, with over 31 million votes.
Citing these numbers, his camp on Wednesday declared him as the victor in the presidential race.
