The Commission on Election (Comelec) on Friday issued a certificate of finality on its decision disqualifying incumbent Albay Governor Noel Rosal.

In a statement, Comelec Spokesperson John Rex Laudiangco said the decision became "final and executory" since the Supreme Court did not issue Temporary Restraining Order (TRO) or preliminary injunction against the poll body.

"Ang isang desisyon o resolusyon ng COMELEC En Banc sa mga espesyal na aksyon (Special Action [SPA]) ay magiging pinal at maisasakatuparan pagkatapos ng limang araw mula sa pagtanggap ng Desisyon o Resolusyon, maliban kung pigilan ng Korte Suprema sa pamamagitan ng TRO o Preliminary Injunction," Laudiangco said, citing the poll body's rules of procedures.

He said the copies of the Certificate of Finality at Entry of Judgement have been sent to the parties Rosal and Joseph San Juan Armogila, a defeated councilor candidate who filed the disqualification case.

Comelec en banc junked Rosal’s motion for reconsideration on Nov. 18.

On Sept. 19, The poll body's First Division disqualified Albay Governor Noel Rosal for violating Section 261 of the Omnibus Election Code.

Rosal reportedly distributed financial assistance to tricycle drivers and senior citizens, despite the enforced public spending ban weeks before the May 2022 national and local elections.
