The Commission on Elections (Comelec) First Division has dismissed the petition filed against the Bagong Henerasyon (BH) Partylist, whose proclamation as one of the winners in the 2025 midterm elections was earlier suspended due to pending disqualification cases.
The petition was filed by Atty. Russel Stanley Geronimo, who accused the party-list nominees of engaging in partisan political activities—an act prohibited under the Party-list Law.
However, in its official ruling, the Comelec First Division stated that the petitioner failed to provide sufficient documentary evidence to support his claims. As a result, the commission decided to junk the case.
"Upon the scrutiny of the submitted petition and its attachments, it appears that the Petitioner allegedly furnished the Respondents their respective copies of the petition via registered mail," the order reads.
"Nonetheless, Petitioner did not submit an affidavit stating the reasons or circumstances as to why personal service was not feasible or that Respondents refused to receive the Petition or that Respondents' whereabouts cannot be ascertained, as required by Section 5 (5), Rule of the COMELEC Resolution No. 9366," it added.
Despite the dismissal, Comelec Chairman George Erwin Garcia clarified that the BH Party-list cannot yet be formally proclaimed. He explained that this will depend on whether the petitioner files a motion for reconsideration. The decision must also become final and executory before any proclamation can proceed.
Bagong Henerasyon is among the party-list groups that secured enough votes to earn a seat in the House of Representatives for the next congressional term.
