Police Senior Master Sergeant (PSMS) John Mollenido’s lawyer, Atty. Cristobal Rimando on Sunday, February 1, maintained that his client has not been arrested and that no court has issued a valid warrant of arrest against Mollenido.

According to the Rimando, Mollenido, estranged husband of the late PSMS Diane Marie Mollenido, voluntarily presented himself to authorities on Sunday, in Novaliches, Quezon City, amid an ongoing investigation into the killing of his wife and their eight-year-old son, said legal counsel in a statement.

The lawyer clarified that reports claiming his clients had been arrested were “inaccurate and misleading,” stressing that ”no valid warrant of arrest” has been issued against his Mollenido.

“We hereby clarify that our client, Mr. PSMS John Mollenido, is not under arrest,” Rimando said.

“As of this time, no valid warrant of arrest has been issued by any competent court against him. Reports or statements suggesting that he has been arrested are inaccurate and misleading,” he added.

Rimando explained that Mollenido’s presence at the police station was voluntary and done in good faith.

“His appearance was an exercise of transparency and respect for due process and must not be misconstrued as an arrest,” he added.

It can be recalled that yesterday, the Quezon City Police District (QCPD) reported that Mollenido had been arrested as the fourth suspect in the crime and had already been presented in inquest proceedings along with three other suspects in the murder case.

Mollenido is currently under police custody and is being treated as a person of interest in the case.

“He also urged the public to refrain from spreading unverified information that could prejudice the case,“ the lawyer added.

Meanwhile, the QCPD said the investigation is ongoing, while the three other suspects arrested in connection with the case are set to undergo inquest proceedings as authorities continue to piece together the circumstances surrounding the deaths of the policewoman and her child.
