DOLE issues pay guidelines for upcoming holidays in August

On Monday, the Department of Labor and Employment (DOLE) issued payment guidelines for the upcoming holidays this August.

According to the Labor Advisory No. 9-A, Series of 2024, employers are to observe the proper payment of wages for August 23 (Ninoy Aquino Day) and August 26 (National Heroes Day).

Ninoy Aquino Day was moved from August 21 to August 23 this year and is considered a Special Non-Working Holiday. According to DOLE’s advisory, employees shall observe the ‘no work, no pay’ principle, unless a collective bargaining agreement (CBA), a favorable company policy, or practice grants payment on the said holiday.

Additionally, employers are required to pay employees an additional 30 percent of their basic wage on the first eight hours of work. Any work that exceeds the mentioned hours requires an additional 30 percent of the hourly rate on the same day.

For employees who will work on the special holiday during their rest days, an additional 50 percent of the basic wage on the first eight hours of work shall be granted. Moreover, an additional 30 percent of the hourly rate shall also be paid to employees succeeding the eight-hour work window.

Meanwhile, August 21 is considered an ordinary working day and shall observe regular payment of wages and wage-related benefits on that day.

DOLE also noted that the pay rules under their Labor Advisory shall also apply to the Regular Holiday on August 26, 2024 (National Heroes Day).

President Ferdinand Marcos Jr. moved Ninoy Aquino Day to August 23 this year to ‘promote domestic tourism’ as it will fall on Friday, observing a longer holiday.
