The Commission on Elections (Comelec) on Tuesday, Oct. 24, approved the resolution which allows the suspension of the proclamation of winning candidates with pending cases.

Under Memorandum No. 231111, Comelec said candidates with the following pending petitions would not be proclaimed:

  • to deny due course or to cancel certificate of candidacy (COC)
  • to declare a nuisance candidate
  • for disqualification

The said proclamation suspension shall take effect "until further orders from the Commission."

"RESOLVED, further, to NOTE the reiteration of the policy in Section 600 of COMELEC Resolution No. 10924, the Presiding Commissioners of each Division and the Chairman, as the presiding officer of the Commission En Banc, are authorized to issue the order of suspension of proclamation of respondent candidates in the above cases," it said.

According to the poll body, a copy of the suspension order must be immediately furnished to concerned Electoral Board and Barangay Board of Canvassers (BBOC) and the respondent-candidates.

"The Office of Election Officer is directed to monitor the implementation of the Order of Suspension by Barangay Board of Canvassers (BBOC)," the Comelec furthered.
