Tax evasion charges loom over Discaya couple, DOJ confirms

The Department of Justice (DOJ) announced on Wednesday that it will file tax evasion charges against Pacifico “Curlee” Discaya II and Cezarah “Sarah” Rowena Discaya following complaints filed by the Bureau of Internal Revenue (BIR).

According to the DOJ, prosecutors found prima facie evidence with reasonable certainty of conviction that the couple violated the National Internal Revenue Code (NIRC), specifically Section 254 (willful attempt to evade or defeat tax) and Section 255 (willful failure to supply correct and accurate information).

Curlee Discaya, owner of St. Gerrard Construction General Contractor and Development Corporation, and Sarah Discaya, owner of Fine Things Fashion Wear House, allegedly concealed or underdeclared their income in their income tax returns for taxable years 2020 and 2021.

Meanwhile, three separate complaints involving non-payment of excise taxes against the couple and St. Gerrard Construction were dismissed.

One case against Sarah Discaya was dropped as she was merely the end consumer of imported vehicles, while cases against Curlee Discaya and the company were dismissed for being filed beyond the five-year prescriptive period under the NIRC.

The DOJ said the corresponding information will be filed with the Court of Tax Appeals, where the couple will face trial.
