A Supreme Court administrator said that the city government of Taguig still needs to secure a writ of execution before it takes over the 10 barangays from Makati City.
This is the response to a query made by Makati Regional Trial Court Branch 64 Executive Judge Gina M. Bibat-Palamos to the Office of the Court Administrator.
In his response to Palamos, Court Administrator Raul B. Villanueva stated that the decision of the Supreme Court’s Third Division should be the subject of a writ of execution before the trial court.
He went on to say that once the write-up is implemented by the Department of Interior and Local Government, it will be the reckoning period for the transfer of jurisdiction of cases emanating from the Fort Bonifacio Military Reservation, consisting of Parcels 3 and 4, PSU-2031, from Makati City to the City of Taguig.
According to Makati City Administrator Claro F. Certeza, Villanueva's response has outlined the measures that must be taken before any jurisdictional transfers may take place.
Certeza revealed that he wrote to Palamos on August 11th to inquire about the transfer of ongoing court proceedings involving the 10 affected barangays.
He received the response from the executive judge on Monday, who quoted Villanueva's statement verbatim in her letter.
Villanueva also stated that "all cases currently filed and pending before the first and second level courts in Makati City should continue to be tried, heard, and decided by the said courts."
Furthermore, Certeza chastised Taguig City for allegedly failing to uphold the rule of law when they launched the annual Brigada Eskwela at Makati Science High School and toured Fort Bonifacio Elementary School and Fort Bonifacio High School, all of which are in Makati City.
He stated that unlawful intrusion into public schools without establishing critical legal processes demonstrates a clear disregard for established procedures and the principle of jurisdiction.
Certeza then encouraged Taguig to adhere to the law in order to avoid confusion among parents and pupils, as well as undue stress in the barangays affected by the Supreme Court's judgment.
He also warned Taguig that Makati City might file criminal and administrative proceedings for illegally attempting to seize ownership of Makati-owned assets.
