The Supreme Court (SC) reversed the Court of Appeals (CA) ruling on the parricide case against racer Ferdinand “Enzo” Pastor’s wife, the Court said on Thursday, October 3.
In a decision promulgated on February 26, 2024, the Court upheld the prosecution’s finding of probable cause against Dalia Guerrero Pastor, the deceased racer’s wife, as a co-conspirator in the latter’s killing.
The decision written by Associate Justice Amy Lazaro-Javier showed the reversal of the CA’s dismissal of Dalia’s criminal case.
According to the SC, the following people were charged: Police Officer II Edgar Angel (PO2 Angel), as the gunman; and Domingo De Guzman III and Dalia as the masterminds behind Enzo’s killing. The two were arrested, while Dalia remained at large.
Due to the lack of probable cause, the CA ruled in Dalia’s favor and dismissed the case against her. However, the SC held that the case does not require evidence of guilt beyond reasonable doubt.
Recently, the SC found sufficient evidence to charge Dalia as a co-conspirator in Enzo’s killing. Testimonies from Enzo and Dalia’s house help revealed Dalia’s affair with De Guzman.
Additionally, the witnesses' claims all pointed to Dalia having an active hand in planning Enzo’s ambush.
“Dalia’s acts, as stated above, show that she not only served as a strong motivation to carry out the plan, but she had an active hand in planning the ambush of Enzo. Too, her abrupt absence after a warrant of arrest was issued on her lends credence to the prosecution’s case that she is probably guilty of the offense charged,” the decision read.
Enzo was last seen driving a truck to Clark, Pampanga with his mechanic, Paolo Salazar, in 2014. A man approached the truck and fired at Enzo when it came to a stop at the intersection of Visayas Avenue and Congressional Avenue.
Dalia currently remains at large and has not personally come forward to submit herself to the jurisdiction of the Court.
