The Supreme Court (SC) on Tuesday ordered the Commission on Elections (Comelec) to comment on the petition filed by Visayas-based An Waray party-list in regards to the cancelation of its registration.
In a press release, SC Public Information Office (PIO) said the higher court directed Comelec and two other respondents Danilo Pornias and Jude Acidre to file their comment within 10 days of receiving the notice.
"The Court required personal filing and service of the Comment," SC PIO said.
It can be recalled that last June, the Comelec Second Division canceled the registration of the An Waray party-list due to its alleged violation in the 2013 National and Local Elections.
The group then filed a motion for reconsideration urging the poll body to reverse the decision, but the Comelec en banc dismissed this.
An Waray party-list then took the matter to the SC by filing of a petition where it questioned the poll body's jurisdiction in ordering the revocation of its registration.
It asserted that it is only the House of Representatives that has the "jurisdiction over cases involving the qualification of its members."
