The preliminary investigation on the slay cases of radio broadcaster Percy Lapid and alleged middleman Jun Villamor has been reset due to an error in the middle name of suspended Bureau of Correction (BuCor) Gerald Bantag.

In an interview with the media, Bantag’s lawyer Rocky Thomas Balisong said the issued subpoena was wrong because it was intended for a different person.

In the subpoena, it was addressed to Gerald Bantag y Soriano instead of Gerald Bantag y Quitaleg.

“It is fatal because it refers to two different individuals. Definitely, Gerald Bantag y Soriano is not our client,” Balisong said.

The justice department issued another subpoena with the correct name which was received by Balisong earlier.

“We just received it. So the reckoning of the 10 days to file our counter-affidavit is starting today,“ he said.

Balisong also dismissed claims that Bantag is hiding because the latter was absent in the hearing.

“He’s in Baguio, joining the community,“ he said.

BuCor Directorate for Security and Operations Supt. Ricardo Zulueta Zulueta, who was also charged as the mastermind in the deaths of Lapid and Villamor, did not attend the hearing.

Only the self-confessed gunman Joel Escorial with his lawyer Daniel Alviar attended.

The next hearing is scheduled on Dec. 5 at 1 pm.
