The Manila Regional Trial Court (RTC) has allowed detained activist Reina Mae Nasino and two other prisoners to post bail after two years.
In the order released Monday, the Manila RTC Branch 47 said it granted the three accused’s petition for bail due to the failure of the prosecution to prove evidence of guilt was strong.
"In these cases, after a careful examination of the evidence presented by the prosecution and without necessarily delving into the validity of the search warrants issued against the accused as the same are still pending before the appellate court, the Court finds that the evidence of guilt against all accused were not strong,” it said.
In 2019, Kalipunan ng Damayang Mahihirap (Kadamay) human rights worker Nasino was arrested along with her fellow activists Alma Moran and Ram Carlo Bautista over alleged fabricated charges of illegal possession of firearms and explosives.
Nasino’s case became controversial in 2020 when she was forced to be separated from her baby named River who died at barely six weeks old.
She was deprived to hold baby River even in her very last moment before she was laid to rest.
The court said that although there were photographs of the seized firearms allegedly recovered from the accused, the prosecution witnesses namely Barangay Chairman Jocelyn Corpuz and Police Corporal Christopher Jacinto “failed to identify the accused and which firearm was recovered from each of them."
“The general testimony of witnesses Corpuz and Jacinto will not suffice to establish that indeed the evidence against the accused was strong,” it said.
The Manila RTC Branch 47 set bail for Nasino and Moran at Php 420,000 each while Bautista will post bail of Php 570,000.
