Mindanawon lawyers, led by Atty. Israelito Torreon, Atty. Martin Delgra, Atty. James Reserva, and Atty. Hillary Olga Reserva, filed a Petition for Certiorari and Prohibition before the Supreme Court (SC) on Tuesday, February 18, 2025.
The petition seeks the issuance of a Temporary Restraining Order (TRO) and a Writ of Preliminary Injunction from the High Tribunal to annul or set aside the impeachment complaint against Vice President Sara Duterte.
Joining the petition are members of the Davao City Council, acting in their capacity as private citizens, and represented during the filing by Davao City Councilor Atty. Luna Acosta.
According to a report by RH Boy Gonzales, a total of 29 supporters joined the petition.
Atty. Torreon claimed that the impeachment complaint against Vice President Duterte was politically motivated and intended to prevent her from running for president in the 2028 elections.
He also argued that allowing the impeachment process to proceed would mislead the 32 million Filipinos who voted for Duterte, potentially undermining their trust in her mandate.
The petitioners also questioned the impeachment process, arguing that the complaint was not properly verified before being filed.
They asserted that the initiation of the impeachment process was procedurally defective, constitutionally infirm, and jurisdictionally void.
