The Philippine National Police (PNP) reported that it is challenging for them to fulfill the senators' request to hand over custody of dismissed Bamban, Tarlac Mayor Alice Guo.
"Yung warrant of arrest issued by the Judicial Court case precedence over the arrest order issued by the Senate," PNP Spokesperson PCol. Jean Fajardo said during a press briefing on Friday.
Fajardo explained that a court order is required before the ex-mayor can be allowed to attend the higher chambers of Congress, including the Senate hearing scheduled for Monday.
Fajardo mentioned that the PNP had originally planned to transfer Guo’s custody to the Senate Sergeant at Arms, following her capture in Jakarta, Indonesia. However, a warrant of arrest from the Third Judicial Region Branch 109 in Capas, Tarlac, which holds greater authority than the Senate's arrest order, was unexpectedly issued.
Fajardo made the statement after Senator Risa Hontiveros and other lawmakers questioned why Guo prefers to remain in PNP Custodial Facility.
According to Fajardo, Guo’s own lawyer filed a motion in court to allow her to remain at Camp Crame, a request that was granted by the judge.
The PNP is also uncertain about whether Guo’s legal strategy is related to the alleged threats against her life.
