

The Securities and Exchange Commission (SEC) on Tuesday filed criminal complaints before the Department of Justice (DOJ) against six companies for allegedly harassing and threatening their lenders who were not being able to pay back on time.
In an interview with reporters, SEC Director Oliver Leonardo said these companies violated Sections (12)1, 12(2)a, and 12(3)(a) of Republic Act No. 11765 or the Financial Products and Services Consumer Protection Act (FPSCA).
"Naghain kami ng kasong kriminal sa paglabag sa Financial Products and Services Consumer Protection Ac sa tatlong lending companies, isang financing, at dalawang BPO," he said.
Among the companies that are facing raps are as follows:
- FESL Lending Investor Corp.
- FESL Business Process Outsourcing Services
- Realm Shifters Business Process Outsourcing Services
- U-peso.ph Lending Corp.
- Philippine Microdot Financing Corp.
- Armorak Lending Inc., Na Nag-ooperate Sa Ilalim Ng “ayudas And We-loan”
"Ang pamamahiya ay palapastangan sa karapatan ng ating mangungutang, ang pag-share ng contact details, ang pambabastos, ito ay isang criminal offense sa ilalim ng FPSA," Leonardo said.
In the filed criminal complaint, SEC said lenders received threatening messages from the companies. Some of the message stated that "Magbayad ka ng utang mo!", "Kapal ng mukha mo! Ano ang gusto mo mangyari? Gusto mo ngayon pa lang, trabuhin na kita", "Magbayad ka ah. Wag mo antayin madamay yang anak mo ah."
