Former Senator Leila de Lima&rsquo;s legal counsel on Tuesday, Nov. 14, plans to move for the dismissal of her case using Muntinlupa RTC Branch 206 Judge Gener Gito&rsquo;s argument that the prosecution had a &ldquo;total failure&rdquo; to prove conspiracy among the accused which led to the approval of her bail.&nbsp;&nbsp;
&ldquo;Mataas po ang kompyansa namin dito dahil meron na po tayong isang order na nagsasabi na yung mga testimonya ng mga witnesses ng panel of prosecutors ay hindi dapat paniwalaan [...] dagdag pa diyan yung statement sa order ni Judge Gito na there was a failure on the part of the prosecution to prove the conspiratorial acts of each and every accused,&rdquo; Atty. Boni Tacardon told DZRH.
&ldquo;We will be using this same argument to move for the final dismissal of the case,&rdquo; he added.&nbsp;
When asked for the next step following De Lima&rsquo;s release yesterday, Tacardon said they were listening to the prosecution&rsquo;s formal offer of evidence containing testimonies of 27 witnesses along with &ldquo;voluminous&rdquo; documents and affidavits.&nbsp;
&ldquo;Sa ngayon po ay pinapakinggan natin yung tinatawag na formal offer of evidence ng prosecution [...] Kami po ay binigyan ng sampung araw para pag-aralan ito at mag-submit ng aming comment at as soon as the court resolves the formal offer of evidence, the rules allow us to submit what we call a demurrer to evidence,&rdquo; Tacardon said.&nbsp;
The demurrer to evidence is an objection from the accused to dismiss the case on the grounds of insufficiency of evidence.&nbsp;
No strategy done on De Lima&rsquo;s release
When asked about the strategy they used following De Lima&rsquo;s release, Tacardon underscored that everything was based on facts and records in the case.&nbsp;
&ldquo;Lahat naman po yan ay nakabase sa ebidensya, sa record ng kaso. Wala naman po talagang espesyal na nangyari dun dahil simula&rsquo;t sapul naman po naniniwala po kami na ang katotohanan at hustisya&rsquo;y mananaig,&rdquo; he said.&nbsp;
&ldquo;[M]apapatunayan natin na ang mga salaysay sa mga akusasyon laban sa ating dating senadora ay mare-reject ng hukuman. Siya po ay inosente mula pa sa umpisa at alam naming ito&rsquo;y lalabas at lalabas din sa dulo,&rdquo; he added.&nbsp;
