The Department of Justice (DOJ) on Thursday filed complaints against Jose Adrian ‘Jad’ Dera and five National Bureau of Investigation (NBI) jail guards and one agent after an alleged unlawful escape from the detention center facility.

Dera was charged with corrupting public officials under Article 212 of the Revised Penal Code (RPC) while the six NBI officers are facing violation of the Anti-Graft and Corrupt Practices Act and infidelity in the custody of prisoners.

Based on the closed-circuit television (CCTV) footage, Dera and the six NBI jail guards were spotted dining in a restaurant buffet after successfully breaking out from the detention on Tuesday evening.

According to reports, the six NBI officials allegedly supported Dera in his excursion and allowed him to ride in an NBI van.

However, the legal counsel of the NBI detainee denied that his client escaped.

“Sinasabi sa akin ni Dera na lumabas siya past 8 PM dahil masama ang kanyang pakiramdam at magpapa-check up,” lawyer Raymund Palad said in an interview with reporters.

“‘Yung subsequent acts na kumakain sa labas, wala ako mapaliwanag doon which is definitely mali talaga iyon na kumakain sa labas,” he added.

Palad also refuted claims that Dera was able to go in and out the NBI facility for four consecutives times, only to travel to places like Tagaytay, Makati, Zubic, and Calatagan, Batangas.

“‘Yung escapade na sa Calatagan and others ay hindi ko talaga alam na nangyari iyan or hindi,” he said.

“I can only confirm ‘yung knowledge ko na paglabas na official, ‘yung sa hospital at saka ‘yung isyu sa orthopedics na dinala siya kasi meron siyang time na nagpa-palpitate ‘yung kanyang heart at tinakbo talaga sa hospital,” the legal counsel added.

On Wednesday, the NBI apprehended Dera, who is a co-accused in one of former Senator Leila de Lima's drug cases, after going out of the facility without authorization.

Some pistols and cash were reportedly retrieved from the escaped inmate.
