The Commission on Elections (COMELEC) en banc has approved the filing of motu proprio complaint against suspended Bamban, Tarlac Mayor Alice Guo for material misrepresentation in her candidacy in the 2022 local elections.
COMELEC Chairman George Erwin Garcia mentioned that the COMELEC en banc had a unanimous decision to proceed with the case against embattled Guo.
The law department would conduct a preliminary investigation soon but assured that they will be giving Guo the chance to explain her side as part of due process.
Furthermore, the department may also issue a subpoena to summon Guo so she could answer to all of the allegations against her.
According to the Section 261 of the Omnibus Election Code, misrepresentation is a criminal offense, with penalties that may range from one to six years of imprisonment.
Previously, COMELEC discovered that the fingerprints provided by the National Bureau of Immigration (NBI) and the Bureau of Immigration is one and the same with Guo's fingerprints in her certificate of candidacy, voter's registration application, and fingerprints recorded on the election day.
