BIR files ₱7.1B tax case against Discaya couple

The Bureau of Internal Revenue (BIR) has filed multiple criminal cases against Pacifico “Curlee” Discaya II and Cezarah “Sarah” Cruz Discaya, as well as one other official of the St. Gerrard Construction General Contractor and Development Corp for a whopping ₱7.18 billion in tax debt.

“Batay sa aming imbestigasyon, may kabuuang ₱7.1 bilyon silang hindi nabayarang buwis mula sa individual income taxes, excise taxes ng siyam na luxury vehicles, at documentary stamp taxes sa mga transaksiyong hindi kailanman na-file o nabayaran,” BIR Commissioner Romeo “Jun” Lumagui Jr. said in a statement.

Lumagui said that the cases filed focus on the couple’s personal taxes from 2018 to 2021, although the agency’s audit of the Discayas’ companies is still ongoing and may result in billions more in tax debt, reported RH 29 Boy Gonzales.

The BIR also discovered that the Discayas failed to file a documentary stamp tax return and did not pay the required taxes for the transfer of their shares in four of their companies—St. Gerrard, St. Timothy, St. Matthew, and Alpha & Omega—contradicting their claim that they had divested ownership of these firms.

In addition, it was found that the Discayas and St. Gerrard Construction did not submit excise tax returns and did not pay the necessary taxes for nine luxury vehicles registered under their name, based on the Land Transportation Office’s (LTO) records.

On Tuesday, the Quezon City local government announced it has terminated four infrastructure projects with construction companies linked to the Discayas.
