Lawyer Levito "Levy" Baligod on Wednesday said the joint affidavit of 18 individuals alleging the delivery of billions of pesos in cash to high-ranking officials will be submitted to the Office of the Ombudsman once it has been notarized.


In an interview with DZRH News, Baligod said the affidavit contains allegations that President Ferdinand "Bongbong" Marcos Jr., several congressmen, and investigators of the International Criminal Court (ICC) received billions of pesos from former Ako Bicol Party-list Rep. Zaldy Co.
Baligod said the filing before the Ombudsman would be for transmittal purposes, noting that the office has the authority to investigate even anonymous complaints.
“Ang intention po namin, I will submit to the Office of the Ombudsman a copy of the affidavit. Transmittal lang po ito. Ibigay ko sa kanya at trabaho naman niya mag-imbestiga kahit anonymous na complaint naman ay naaksyunan,” he said.
He added that a copy of the affidavit would also be submitted to the ICC to inform the tribunal about the alleged conduct of its investigators in the Philippines since 2023.
“Ang pangalawa, I intend to submit to the ICC a copy of the affidavit to inform the ICC about the conduct or demeanor of its investigating officers or ICC investigators in the Philippines. Meaning to say for ICC to determine whether these ICC investigators conducted a bona fide investigation in the Philippines.”
Baligod said the move would allow the ICC to determine whether its investigators conducted a bona fide investigation in the country.
He further said copies would be furnished to embassies of ICC member-states so they could assess whether their continued membership and annual contributions remain justified in light of the alleged conduct of ICC personnel.
“Magbibigay ako sa mga embahada ng iba't ibang miyembro ng ICC para suriin din nila kung ang kanilang membership at ang kanilang annual na contribution sa ICC ay tama pa rin hanggang ngayon dahil sa conduct ng mga taong ito,” he said.
Baligod also cited statements attributed to the U.S. State Department criticizing the ICC as corrupt and politicized. He claimed that most individuals prosecuted by the ICC come from developing countries and questioned the tribunal’s ability to enforce arrest warrants against leaders of powerful nations, including Russian President Vladimir Putin and Prime Minister of Israel Benjamin Netanyahu.
Meanwhile, he clarified that their affidavit does not state that all 18 individuals are members of the Philippine Marine Corps, clarifying that only two are connected to the military and were formerly linked to the Army.
“Hindi naman namin sinasabi sa kanilang affidavit na lahat sila ay marines. Malinaw doon, dalawa ay sa army connected dati,” Baligod said.
Trillanes linked to alleged cash deliveries; vows to file charges
Baligod also implicated former senator Antonio "Sonny" Trillanes IV, alleging that he provided ICC investigators’ contact numbers to alleged bagmen of Co.
He claimed that from 2024 to 2025, ICC personnel frequently entered and exited the Philippines and were allegedly assisted by individuals linked to Trillanes.
Trillanes, in a separate interview with DZRH, denied the allegations and questioned the timing of the witnesses’ public appearance, claiming it was meant to discredit the ICC’s proceedings involving former president Rodrigo Duterte.
He said he would file cyber libel charges against Baligod and others, including Mark Defensor, Jay Sonza, and the 18 individuals who surfaced publicly.
“Malaking kalokohan ‘yan. Ako po ay magpa-file ng cyber libel cases at Levy Baligod, Mark Defensor, Jay Sonza at doon sa 18 na lumabas kahapon na apparently yung 4 na lolo ay hindi naman sundalo at iba naman ay mga nag-abul. Kaya nakakalungkot man para sa mga dating sundalo na yan, pero talagang kailangan nilang harapin itong kasong isasampa ko kasi hindi naman pwedeng ganun-ganun na lang na gagawa-gawa kayo ng kwento,” Trillanes said.
Trillanes also confirmed that he knows the ICC investigators named in the affidavit.
He warned that publicly disclosing the names of ICC investigators and witnesses could constitute a violation of Article 17 of the Rome Statute and may expose those responsible to possible obstruction of justice charges for allegedly endangering the lives of investigators and witnesses.
“Dahil diyan sa ginawa nilang in-expose nila yung mga pangalan pati yung mga testigo, ito po ay violation ng Article 17 ng Rome Statute at ito po malamang sa malamang ay kakasuhan sila ng obstruction of justice kasi nilagay nila sa peligro yung buhay ng mga ICC investigators at higit sa lahat yung mga testigo,” he noted.
